NLRB Posting Requirement for NON Union Employers
NLRB Posting Requirement
The National Labor Relations Board (NLRB) rule that all employers covered by the National Labor Relations Act (which encompasses most all employers in the U.S.) post “Notification of Employee Rights under the National Labor Relations Act“ is now effective April 30, 2012, and is set to go into effect on that date. However, a federal district court opinion in D.C. has held that the NLRB exceeded its authority by including provisions in the posting requirement that permit the NLRB to deem failure to post an unfair labor practice and to toll the statute of limitations for claims brought by employees against employers who failed to post the notice. It remains to be seen whether or not the decision will be appealed, but for now the upcoming notice requirement remains in effect.
